[Marble-devel] Mapquest Open files

I'm in a "discussion" with an editor on Wikipedia here, http://commons.wikimedia.org/wiki/Commons:Deletion_requests/File:Citadelle_de_quebec_open_street_map_mapquest.png about a map I uploaded that uses the MapQuest Open overlay in Marble. Are these MapQuest maps also freely distributable under an open source license (CC-by, GPL or what have you)? I assume they are, but I need proof.

The sooner someone can respond, the better.
