Doesn't matter.
Once the developer knows something is covered by a patent he can't use it in 
GPL code as to him the GPL only applies if nothing in the code could restrict 
its freedoms (if I remember correctly patents are explicitly stated)

True, but an unoffical patch would be quite useless, you would have to compile 
the application/library in question yourself all the timer its code changes.

As far as I know only their magnifying algorithm is patented (which makes it 
look like it is coming towards you).
