yes, I have a filter rule which runs "spamoracle mark", but this filter is 
almost the last one so the distribution of mails to the mailing list folders 
appears bevor the spam check and then the spam check filter is not reached.

no, they stay.

I have real loss of mail bodies. That is: I have mails where I only see the 
subject but no content (and no content on disk) - and no duplicate mail which 
shows the content!
So people send me mails which I can not read :-(
