I, too, have had this behavior when opening my Downloads folder for the last 3
or 4 weeks. One thing to note, is that this only appears to be the case when
the Downloads folder is set to show thumbnails/file previews.

Disabling the file preview in the view settings makes the folder at least
remember the view settings, as soon as I re-enable the previews, the Downloads
folder will revert to sorting and grouping the folder by date.
