  Yes, but it causes another bug (or at least an odd behavior): without the patch, the Open With menu has two items: Dolphin and Gwenview. With it, Gwenview becomes its own top-level menu item and Open With... becomes ellipsized and only opens the open with panel.
  
  Still, you're right that this patch fixes a bug, and the new issue should be fixed elsewhere.
