Yes, this is a katepart "bug", and a duplicate of 
http://bugs.kde.org/show_bug.cgi?id=54241. 
 
As you can see, the kate devels don't consider this a bug.  
 
In your editor settings, under "view defaults", you have a setting that says "show 
folding markers if available". If this is checked, any new document will open with folding 
enabled, and any existing document will have them back after a save. (I'd argue that 
the latter case _is_ a bug, but I guess the final word has to go to the kate devels.)
