ok, I found out what is happening here

if my ISPs server attaches a line to this email (they use spamassassin)
X-Spam-Level: *
then kmail also uses bogofilter to check if this spam or not, the the conflict
message shows.

If I set my ISPs email account to not send 
X-Spam-Level: *
then the conflict message doesn't show.
