from further testing I believe this has a lot to do with how emails are
deleted.

I.e. 
drag/drop into trash - fine
right click (then click trash with shift held down then shift held down again
when clicking delete) and then right clicking on trash to delete trash caused
kmail to die as above.

Fix was delete all emails in .kde/share/apps/kmail and then delete the mail
directory and all subdirectories, then to import all emails back in.

further testing being done to narrow this down further.
