That's of course assuming that these clauses are enforcable. However, as per
§5 a user could argue that he has not accepted the terms of the GPL and that
therefor its terms are not applicable. There is also a danger that the broad
disclaimer terms in §11 and §12 are considered in breach of local consumer
protection laws and voided as a result.
