it's probably auto-hiding; you can most likely expand the system tray with the 
little arrow to get at it, and control its autohide behaviour via the system 
tray control panel.

if the icon truly is being completely destroyed / removed when there are no 
updates, then that's very unfortunate and today unecessary now that we have 
the StatusNotifierItems which allow the icon to publish all such necessary 
information so the system tray can do the right thing.
