Files in kdenonbeta/gadget

There are a couple of files in kdenonbeta/gadget that might be problematic:

and 
http://webcvs.kde.org/cgi-bin/cvsweb.cgi/kdenonbeta/gadget/MapQuest.xml

I'm looking forward to webservices support, but those copyrights worry me. Can 
someone with more copyright knowledge than I say if this is "fair use"?
