Downloading "obviously illegally created copies" (what exactly that 
means will have to be decided at court; but it's pretty much obivous 
that any copyrighted material on a p2p network has to be considered 
illegal if you want to be safe) is illegal in Germany since Sep 13, 
2003. The music industry will happily sue you.

Auch den P2P-Netzwerken geht es juristisch an den Kragen. Die Änderung 
des Paragraphen 53 UrhG erlaubt nur noch solche Privatkopien, die nicht 
von "offensichtlich rechtswidrigen Vorlagen" stammen. Was genau 
darunter fällt, dürfte für den juristischen Laien allerdings kaum 
erkennbar sein und bedarf einer Definition durch die Gerichte. Der 
Passus richtet sich jedoch ganz offensichtlich gegen P2P-Tauschbörsen. 
Wer zukünftig gar unter Umgehung eines Kopierschutzes geschützte Werke 
bei Kazaa und Co. anbietet, macht sich unter Umständen gemäß Paragraph 
108b des neuen Gesetzes sogar strafbar. Schadensersatz- und 
unterlassungspflichtig ist er ohnehin, wie zukünftig auch derjenige, 
der die "verbotenen Früchte" herunterlädt.
