While the Recording Industry Association of America (RIAA) continues to
pursue file-swapper prosecutions, the Supreme Court of the Netherlands has
reaffirmed it lawful to make the file-sharing software, KaZaA, available to
the public.

The decision confirms a March 2002 ruling of the Amsterdam Court of Appeal,
which concluded that KaZaA does not constitute direct copyright infringement
and is not unlawful towards the plaintiff, music-rights society,
Buma/Stemra.
