Finally someone who understands copyright law: the publisher is in
violation. That is, *the publisher*, not someone who wrote software that
*could* be used for it. If I put Britney's CDs[1] on my website, the Apache
HTTPD team isn't liable for copyright violations.

[1] Bad example, I don't own any.
