Well, if he has updated it to make it compile, it is still in a maintained state. It shows the developer(s) is(are) still interrested at providing their software. The very least we have to (and a strong emphasise on the "have to") is to speak with him(them) before even pushing much further the possibility of reusing the name.<br>
